Letters to the Editor

City zoning laws for trailers are not being enforced

Editor, The Times: A manufactured home has been moved into our neighborhood in what is an obvious violation of the Pierce County Zoning and Land Use Ordinance.

The code says in section 3-22 Mobile Homes. No mobile homes, defined as units constructed prior to June 15, 1976, shall be allowed within Pierce County, Blackshear, Patterson, or Offerman. Only manufactured homes constructed to the Federal Manufactured Home Construction and Safety Standards governed by the National Manufactured Housing Construction and Safety Standards Act of 1974, as amended, 42 U.S.C. 5401, et. Seq., shall be permitted within the corporate and unincorporated areas of Pierce County. However, no manufactured homes shall be permitted within the city limits of Blackshear.

The manufactured home was moved in 7 1/2 months ago on Lakeview Drive inside the city of Blackshear. The owner hooked it up to power and water himself with no permit or no sticker on the manufactured home.

Manufactured homes and mobile homes are not allowed in the City of Blackshear. However, Pierce County cannot enforce the code ordinance that we have against this.

Our understanding is the owner has been cited in Magistrate Court and the case has been appealed to State Court.

Penalties in section 12-5 and 12-6 of the code says: the offender shall, upon conviction in Magistrate’s Court, be fined no more than five-hundred ($500) dollars or imprisoned for not more than sixty (60) days, or both, for each offense and 12-6 Enforcement. The Magistrate's Court of Pierce County shall have jurisdiction over violators of this ordinance.

The mayor, the city council, the county manager, the county commissioners, the county attorney nor the city attorney can’t do anything about this! Once it’s done, it’s done.

So y’all get ready and order one for your backyard. I am thinking about a tiny house right here on the lake.
